Pursuant to art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to give reasons and without any penalty, within 14 (fourteen) days from the date of receipt of the products.

To exercise the right of withdrawal referred to in the previous article, the Customer must send Dalmi srl a communication to that effect, within the terms indicated, to the following email address firstname.lastname@example.org
Once the above communication has been given, the Customer will receive an authorization code, which must be shown on the package, and must return the products to Dalmi srl within 14 (fourteen) days of the withdrawal, to the following address:

The cost of the return shipment will be borne by the Customer, who can use his preferred courier.
TERMS AND CONDITIONS
In order for the customer to be entitled to a refund, the return must comply with the following conditions:
– The goods must be returned intact, possibly using the packaging in which it was delivered, or one of equal strength, sealed with adhesive tape on all openings.
– A label must be affixed showing the sender’s data, the shipping address and the authorization code received. Alternatively, it is possible to write the requested data by hand in capital letters on the packaging using an indelible marker.
– The shipment, until the certificate of receipt in the warehouse indicated by Dalmi srl, is under the complete responsibility of the customer;
– In the event of damage to the goods during transport, Dalmi srl will promptly notify the Customer, to allow him to file a complaint against the courier of his choice and obtain the relative refund; the product will then be made available to the Customer, simultaneously canceling the request for withdrawal;
– Dalmi srl will not be liable in any way for damage, theft or loss occurring during or in any case depending on the return shipment.
– Returns cannot be accepted for custom made products.
Dalmi srl will reimburse the Customer for the full amount of the returned items, within 14 (fourteen) days of withdrawal, by reversing the amount charged, using the same payment method used by the Customer for the initial transaction, unless otherwise agreed. In case of payment by bank transfer, the customer must inform Dalmi srl of the IBAN code to which to make the refund. In any case, the Customer will not incur any costs as a consequence of said reimbursement. Dalmi srl may suspend the refund until the returned product is received or until the Customer demonstrates that he has correctly returned the product, whichever comes first.
In any case, the Customer will lose the right of withdrawal in cases where Dalmi srl ascertains that:
– The return shipment has not been previously authorized by Dalmi srl by communicating the code to be affixed to the package;
– The returned product is not intact;
In the event of forfeiture of the right of withdrawal, Dalmi srl will return the purchased product to the sender, charging the shipping costs and, if already reimbursed, the price of the product.
RETURNS FOR DEFECTS OF CONFORMITY
In compliance with the obligations deriving from Legislative Decree 206/2005 concerning lack of conformity, the Customer may exercise his right in the following ways:
– Send written communication to Dalmi srl at the Email address: email@example.com within two months of the appearance of the defect, attaching a copy of the purchase invoice to the communication. The validity period for the warranty right is 24 months for final consumers only, while it is limited to one year only for items purchased not by final consumers (companies/professionals) as established by the aforementioned Legislative Decree.
– The Warranty starts from the delivery date and covers all the parts for which it has been agreed that they are actually attributable to the quality of the workmanship or to material defects. Parts subject to wear, electric motors, all damage caused by handling and transport, by use, maintenance, repair of the machine by unauthorized personnel and by failure to comply with the instructions in the manual are excluded from the Warranty
– Following the communication, the Customer may receive a request for photographic documentation for an initial evaluation.
– The Customer will receive a return authorization code which he must affix to the package.
– The customer must send the defective item to Dalmi srl – Via Zanovello, 8 – 36075 Montecchio Maggiore (VICENZA) – ITALY, using suitable packaging to protect the contents, sealing all openings with adhesive tape.
– The package must have a label showing the sender’s data, the shipping address and the authorization code received. Alternatively, it is possible to write the requested data by hand using an indelible marker.
– The costs for the return to Dalmi srl are charged to the Customer, who can use a courier of his choice.
Once the package has been received, the verification procedure for the disputed defect will be activated.
At the end of the verification procedure, if a lack of conformity has actually been found, the customer will receive the item duly repaired without charge, or a replacement with a new one if available, or a refund of the price paid.
In the event of a refund, the IBAN code on which to carry out the credit will be requested.
In the event that no lack of conformity is found, or the conditions of wear of the article make it impossible to establish whether or not it is a lack of conformity, the article will be returned to the sender without any charge.
Once the order has been confirmed, the shipment will take place within the second working day following confirmation (a working day is to be understood from Monday to Friday, excluding holidays recognized by the Italian calendar).
Dalmi srl reserves the right to verify the validity of the transaction, possibly also by contacting the counterparty’s bank. In this case, the shipment of the goods will not take place until the verification procedure has been successful.
The shipment throughout the national territory and to foreign countries will take place with delivery in 2-5 days (any customs procedures may increase delivery times).
Delivery times are indicative and based on the average delivery times of the couriers currently used. Any delays in delivery will not give the right to full or partial refunds of the goods purchased.
Austria, Belgium, Denmark, Finland, France, Germany, Greece, Ireland, Luxembourg, Monaco, Netherlands, Portugal, Spain, Sweden, United Kingdom.
All shipments are made in packages sealed with adhesive tape. Upon delivery, the Customer is required to check the integrity of the packaging and the adhesive tape. In the event of breakage or tampering with the wrapping or adhesive tape, the Customer must sign the content verification reserve to the courier before collecting the package.
In the event of missing items or damaged items, promptly notify Dalmi srl in the manner prescribed for returns. Claims on shipments received by the Customer without reservation will not be accepted.
For shipments outside the European Union, any import customs fees will be charged to the customer. Customs duties and any taxes vary according to the country of destination and are applied upon arrival of the goods in the same country: the Customer is therefore invited to contact the customs authorities of his country in advance to check the costs and any import limits.
In case of refusal of the goods by the customer or non-delivery for other reasons (e.g. wrong address and/or telephone number of the recipient; repeated absence of the recipient, etc.) the amount will be retained to cover the following expenses: shipment of goods + return of goods + customs for return and charged to the recipient. Instead, the price of the goods will be refunded.

GENERAL CONDITIONS OF SALE
ART. 1 – ACCEPTANCE OF THE GENERAL SALES CONDITIONS AND CONCLUSION OF THE CONTRACT
The contract stipulated between Dalmi srl and the Customer must be considered concluded with the acceptance, even if only partial, of the order by Dalmi srl. In the event of non-acceptance of the order, Dalmi srl will in any case promptly notify the Customer.
By placing an order in the various ways provided, according to the order form on the Site (hereinafter the “Order”), the Customer declares to have read all the information provided to him during the purchase procedure and to fully accept these general conditions (hereinafter the “Conditions”).
These Conditions can be printed or saved on a durable medium, in compliance with the provisions of art. 12 of Legislative Decree 70/2003 and by art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.
ART. 2 – PURCHASE METHOD
The products offered for sale by Dalmi srl are only those present on the dalmikarting.com website at the time the Order is placed, as described in the relevant information sheets.
Once the order request has been received, Dalmi srl reserves the right to reconfirm the availability of the items purchased, the validity of the credit card transaction and to check the details of previous transactions made by the Customer on DALMIKARTING.COM. In the event that the items ordered are not available, or if for some reason the order cannot be processed as requested by the Customer, Dalmi srl will promptly notify the Customer.
In any case, it is understood that the images accompanying the description of a product are for informational purposes only and may not be perfectly representative of its characteristics but may differ slightly due to the product update.
Dalmi srl undertakes to constantly monitor the contents of the site and to correct any errors in the descriptions and images.
In order to place an Order, the Customer must fill out the relative form on the Site in its entirety and send it after having carefully read the Conditions, as well as the characteristics of the product and/or products he intends to purchase. The Customer must also ask Dalmi srl, if desired, to issue a tax invoice relating to the purchase, pursuant to art. 22 D.p.R. no. 633/1972.
In this case, the customer will automatically lose the right of withdrawal and the right to the guarantee, as provided for by the consumer code, will be limited to twelve months from the date of purchase of the product.
Correct receipt of the Order is confirmed by Dalmi srl by means of an e-mail reply, sent to the e-mail address communicated by the Customer. This confirmation message will summarize the purchase conditions, as required by the applicable legislation, as well as the data entered in the Order by the Customer, so that the same can verify the same and possibly communicate the necessary corrections of incorrect data without delay.
ART. 3 – PRICES AND PAYMENT METHODS
The prices indicated on the site are to be considered inclusive of taxes and duties applicable in the billing country. Any shipping costs or payment costs are in any case communicated in advance to the Customer through the site or these Conditions. It should be noted that it is possible to indicate separate shipping and billing addresses as long as they are within the same country. All orders that violate this condition will be cancelled.
The prices indicated on the site are subject to change at any time without notice. In any case, the sale price will be the one indicated at the time of order confirmation.
If the price of an item is evidently the result of an error and clearly outside any market logic, Dalmi srl reserves the right to cancel the order at any time and reimburse the Customer for the amount paid, without the possibility for the Customer to object .
The prices indicated on the site are expressed in Euros. If the conversion in currencies other than the euro is indicated, it will be purely indicative and not binding for the conclusion of the purchase contract. The Customer is invited to check the conversion rate with his own currency through his bank before concluding the order.
The following payment methods are foreseen:
The PayPal circuit can be used by the customer for payment according to the specific methods of the same. In the absence of a PayPal account, the customer can make the payment by credit card (Visa, Mastercard; AmEx) through the secure server of the PayPal system.
In case of purchase by bank transfer, the bank coordinates for payment will be displayed. The shipment of the goods will take place only upon effective receipt of the payment in the bank.
ART. 4 – PRIVACY
The personal data collected with the forwarding of the Order will be processed by Dalmi srl for the sole purpose of satisfying the express requests of the Customer, in compliance with Legislative Decree 196/2003 and the privacy information on the site. Any further processing will be carried out only with the express consent of the Customer.
ART. 5 – APPLICABLE LAW
The sales contract referred to in these Conditions and its execution is governed by Italian law, with the disapplication of conflict rules and the United Nations Convention for the International Sale of Goods. The Court of the municipality of Vicenza will be competent to resolve the related disputes.
ART. 6 – COPYRIGHT
Trademarks, logos and other distinctive signs on the site belong to their respective owners. The use of trademarks, logos and other distinctive signs including reproduction on other websites by unauthorized third parties is prohibited. The contents of the site are protected by copyright (texts, images and graphics).
All images and texts are the exclusive property of Dalmi srl and their use by third parties for commercial purposes is expressly prohibited.
ART. 7 – AGREEMENT
The contract replaces all previous contracts, agreements and understandings between the parties and constitutes the entire agreement between the parties regarding the subject of the contract, together with the order, the general conditions relating to the use of the site and the relative conditions to the registration service. Any variation or modification of the contract must be accepted in writing by both parties.
ART. 8 – COMMUNICATIONS
All communications between the parties must be made in writing and sent to the address of the other party indicated in the contract and in the order. Communications sent to the e-mail address of the other party, indicated on the site and in the order, are also intended to be sent in writing.
Communications relating to the validity or existence of this agreement must be exclusively delivered by hand or sent by registered letter with acknowledgment of receipt.
ART. 9 – INTERNATIONAL SHIPPING
The site is visible and accessible from all over the world, however shipments are only possible to countries on the list of permitted countries, which can be consulted here.
ART 10 – PURCHASE REQUIREMENTS
To conclude a purchase on the dalmikarting.com website, the Customer must meet the following requirements:
– Be at least 18 years old.
– Possess the necessary requirements to be able to enter into legally binding contracts.
– Have a valid email address.
– Possess a valid credit card for payment: Visa, MasterCard, American Express or a Verified PayPal account or a bank account
